Affordable rental initiative gives landlords tax deduction for discounted rents

Melbourne renter Rebecca Shiels never expected the generosity of a landlord to help her get back on her feet.

As a newly single mother, she feared for her ability to find a suitable home for herself and her young boy, in a market in desperate need of more affordable properties.

“When I separated I had nothing and was living with family and just trying to get back on my feet and the idea of renting on my own was so appealing but on the financial side of it I couldn’t do,” she said. “I have a little boy, and rentals that were in my financial capacity were not great for him, they didn’t feel safe.”

That was until she came across a two-bedroom apartment in Ormond, in Melbourne’s south-east, advertised for $300 a week — $250 below the market rate — with HomeGround Real Estate, a not-for-profit real estate agency opened in 2014.

“It’s been life-changing for me,” said Ms Shiels, who worked at a beauty salon at the time, and took a job at a tech company just before the pandemic hit. “When I found this one it was amazing. We’ve been here for 18 months now, [my son] Ted has started school here and it’s allowed me to get back on my feet.”

HomeGround reinvests its profits back into the community through Launch Housing, and in more recent times has given landlords who rent out properties for at least 10 per cent below the market rate the option to claim the difference as a charitable tax deduction.

Similar schemes are operated by HomeGround agencies in Sydney and Canberra, operating under Bridge Housing and Community Housing Canberra, respectively, and landlords offering rent reductions may also be eligible for land tax exemptions and capital gain tax discounts under other government measures.

Claire-Anne Willis is among the growing number of landlords offering reduced rents in Melbourne

“We’re of a generation where we’ve been able to acquire and earn well and we want to make sure that we’re not making it too hard for the next generation,” Ms Willis said. “My husband works in public health and I work in welfare, we know the plight of people who face challenges with the rental crisis and housing unaffordability and want to be part of the solution.

In addition to the property rented to Ms Shiels, the pair decided to bring across two other investment properties to HomeGround during the pandemic.

“We worked out what we needed in terms of a return, what would cover our bills and we decided we would [rent one property out at a] significantly lower rate, one a bit lower and then one at market rent or just below,” Ms Willis said.

Simone Curley, principal of HomeGround in Melbourne, said 95 of almost 300 investment properties managed by the agency were leased at a below-market rate, with their portfolio growing by about 75 per cent over the past year. Discounts on properties range from 10-50 per cent, and tenants must meet income-eligibility criteria.

The group saw an uptick during the pandemic “purely because people wanted to do something good, they started to see homelessness as an issue and saw that it can affect anybody”, Ms Curley said.

Tapping into the private rental market was providing much-needed affordable housing supply, Ms Curley said, and giving people the opportunity to live in areas they otherwise couldn’t afford.

“The difference it makes in someone’s life is extraordinary and we find those tenants remain in the property for longer, they’re good tenants and appreciate the opportunity,” she said.

Ms Shiels had previously tried to rent in the area but ended up moving back in with her parents because she could not afford to do so.

“I was living off credit, I couldn’t afford to live week to week. I tried for a while in an apartment but got to breaking point and had to move back in with my mum, as I was getting swamped in debt,” Ms Shiels said. “I couldn’t afford it here now [without the discount]. It’s helped me so much.”

While reducing rent was not an option for everyone, Ms Willis said, she would strongly encourage other landlords to look into the initiative — adding they could be reassured they still got a choice when it came to asking rents and tenant selection.

It’s been tougher to get landlords on board in Sydney, the nation’s most expensive property market, but interest is growing, said Fiona Ivanusa, manager of HomeGround Real Estate Sydney, which is only in its third year. The agency manages almost 260 properties, 40 of which are privately owned rentals with eight offerings discounted rent – mostly coming on board during the pandemic with an average discount of 25 per cent.

“That’s eight families who would otherwise be struggling to pay full market rent,” said Ms Ivanusa. “We are very keen to see these numbers grow. It’s heartening to know that HomeGround is making a real contribution to delivering more affordable housing in partnership with our growing number of ethical landlords.”

She noted the tax deduction, coupled with capital gains tax exceptions for affordable housing, meant landlords could leverage their investment for good with minimal impact on the hip pocket.

The initiative would not solve the severe shortage of affordable housing, but would make a difference to the individuals it helped, said Peter Phibbs, a senior research fellow at the University of Sydney, who has rented out his own Melbourne investment property with HomeGround.

“Big picture, we’re not going to solve the affordable-housing problem with individual landlords making an ethical choice; the preferable thing would be the government confronting the problem of runaway housing price, but it doesn’t look like they’ve got appetite for that,” Professor Phibbs said. “It’s not a solution, but it can make a contribution to people’s lives by providing decent housing at a good price with an ethical real estate agent.

W e recently experienced a major issue/problem with one of our rental properties.

The tenant called about 9pm on a Sunday night to say she had returned home to find water was coming through the ceiling into the living area downstairs.

The tenant called about 9pm on a Sunday night to say she had returned home to find water was coming through the ceiling into the living area downstairs.

Fortunately, the tenant had the presence of mind to turn the water off at what she thought was the source and mopped the floor.

A couple of hours later she contacted us again to say there was another leak and that this time she couldn’t stop it.

A friendly neighbour helped her turn the water off at the mains, but so much water had escaped that it caused the ceiling to collapse.

It also caused flooding to the adjacent townhouse.

Significant damage

The lower level of the property sustained significant damage which took many weeks to remediate.

Although we have not previously experienced this problem, we have since discovered that water damage claims are by far the largest source of claims on insurance, and that, as in this case, flexible braided hoses account for around 20% of water damage claims, across all types of property.

A burst hose with pressure can deliver 1500 litres of water per hour into your home.

It appears that these hoses have a limited life span, with some ‘failing’ after only five years.

There are various options to reduce the likelihood of bursting hoses and we suggest you ask your plumber for recommendations.

There seems to be a lot of positives in the property market right now, giving the appearance that this could be a very good time to be a home buyer or to make the decision to become a property investor.

Sydney’s auction clearance rate is now averaging around 70% – well above what was happening last year and 60% at the beginning of the year.

Private sales on the East Coast and generally across Australia are rising and when you consider that the figures are from July, one of the quietest months of the year, it is obvious that sentiment has changed.

In WA, the state that has been in a five year depressed market, the rental vacancies have dropped dramatically to approx. 2.5% and 54% of Perth’s suburbs saw an increase in leasing activity during July with the top five suburbs having an increase in activity of 114%.

Many property industry forecasters are advising first home buyers and prospective upgraders to make their move soon to take advantage of current conditions before the market makes further recovery and prices rise.

In effect that means those who snooze are going to lose out on the opportunities that are currently being presented in a market that is offering low prices and the lowest interest rates ever.

Tenants coming to the end of their rental agreement undoubtedly want to get their rental deposit back at the end of their tenancy. Usually this a fairly substantial sum of around four weeks’ rent, representing a significant outlay especially for younger renters.

However, there can be situations where your landlord is able to keep a portion, or the total, of your rental bond. Luckily there are ways to avoid this from happening or to salvage as much of your bond refund as possible.

Here are 10 steps towards getting your bond refund.

1) Check your initial condition report before applying for a bond refund

Find the condition report provided to you by your property manager when you entered the house. This will quickly allow you to assess the condition of the house relative to when you moved in. Your property manager will be using this same report to determine whether they need to deduct funds from the bond.

Take the report room by room and note down anything that’s substantially different from the original report.

Include areas where damages has occurred, or the condition has changed significantly, including the gardens. Take care to allow enough time prior to your departure that you can repair, replace, clean or account for all the items you uncover.

2) Be honest about what counts as damage

Not everything you have noted down is likely to count as damage. In fact, some may fall under the category of ‘fair wear and tear’. While it is up for debate what may count as ‘fair’, rest assured that if you have used the property with care and consideration it’s unlikely that much of the general wear would have caused damage.

However, accidents do happen. It’s time to be honest with yourself about what is actually damaged or broken, and account for this in writing. If the property manager does ask you to pay to replace or repair these items you can seek your own quotes to ensure that they are realistic.

3) Speak directly to your property manager

At this point you need to get in touch with your property manager about any of the damage. Some of it may be fixable. In fact, if your property manager suggests that you may need to pay replacement costs then you may want to keep in mind that a repair job is usually less costly and, under tenancy regulations, should be the first consideration.

For instance, stains on the carpet can usually be repaired – if the stain is so bad it cannot come out, the piece of carpet with the stain on can be cut out and replaced by a professional. This will be a far smaller outlay than the cost of re-carpeting a whole room.

Being honest with your property manager will also put them on side. If they come for the final inspection to find a number of items broken or damaged then you may find them less willing to negotiate a favourable outcome. Remember, if you attempt some of the repairs yourself and they are not up to standard, you may see yourself paying even more.

4) Remember your obligations as a tenant

It is a requirement under the Tenancy Act that you provide the correct notice to vacate, even towards the end of a fixed lease agreement. If you break the lease or fail to provide adequate notice then you will find yourself paying the costs as a result. This will usually come from your bond.

5) Bring in the professionals

Now it’s time to bring in the professionals. One of the crucial parts of retaining your bond is ensuring you leave the property clean. Some lease agreements require professional steam cleaning of the carpets and even pest treatments if you have had pets.

Depending on your own personal abilities, it may also be worth hiring gardeners and even window cleaners to get the property back into shape.

6) Undertake other cleaning as necessary

Of course, much of the cleaning work can be done yourself. With a bit of elbow grease, some spare time and some cleaning products, you should be able to bring the property back up to scratch.

Remember to get into the areas you don’t clean as often. The dishwasher, if provided, and oven need to be clean. The top of doors and picture rails should also be free of dust. It can also be worth cleaning out the vents of air conditioners and heaters.

7) Properly vacate by the due date

While it’s common sense to be vacated by the agreed upon date, some tenants overstay by a few days for a variety of reasons. This will incur extra rental costs.

Many tenants also believe they can leave things behind, like old furniture or white goods. Avoid this at all costs as the removal expense might be deducted from your deposit.

If you are keen to leave things behind or do need extra time to vacate, communicate clearly with your property manager as soon as possible. They will appreciate your honesty and can discuss with you the available options and costs.

8) Return all keys and household items

Tenants are expected to return all of the keys they were initially given and any other items (such as garage remote controls and doorbell functionalities). Failure to do this may incur the cost of not only replacing those keys or items, but often replacing the locks. Missing keys may be a sign that you have kept one and the house may be seen as insecure.

9) Attend the final inspection in person

When your landlord or property manager comes for the final inspection of the property, ensure that you attend.

If you uncover a few outstanding items that need to be cleaned or damages that need to be discussed, you can try and resolve these issues straight away.

10) Understand the bond refund process

Lastly, know the process for the bond to be returned. These vary slightly by state but in NSW, your property manager will submit a claim to Rental Bonds Online (RBO) to return the bond in whole or in part to you.

You will need to include financial details for where the bond should be returned to and your contact details.

If yourself and the property manager can’t agree on the bond refund amount then you may be heading to mediation and to Tribunal. Ultimately, you will be asked to provide evidence that backs up your dispute and justifies why you should be entitled to the return of the bond.

What a property manager and landlord want to know is that a prospective tenant will pay their rent on time, look after the property and generally be a good person to deal with over the life of the tenancy.

But the big question is, who should tenants put as references on their rental applications? And how many is best? Here’s everything you need to know.

How many referees do I need?

Michelle Wilde , the principal of Queensland-based Stella Property, said two references from a would-be tenant’s two most recent property managers is standard across the industry.

The property manager will also get a copy of the rental ledgers from the properties.

A rental ledger, also sometimes called lease ledger or tenant ledger, is an official record of all the rent and other payments a tenant made to the property owner. It can be a physical document or an electronic record.

Can I use personal referees?

Citing a personal referee on a rental application is allowed, but not the top choice for an application, according to Ms Wilde.

However, for renters who are entering the market for the first time, this could be their only choice and will be accepted as an official reference.

Who makes a good referee?

The best referees a potential tenant can put on their rental application are recent property managers, as they offer the most up-to-date and reliable information.

Ms Wilde said applicants should understand that the opinion of former property managers matters more than anyone else’s rental reference, as they have first-hand experience of dealing with the tenant.

“It tells me if you pay your rent on time, which is the single-most important attribute, if you’ll look after the property, if you’re easy to get along with, if you report maintenance issues, if you have a pet and so on,” Ms Wilde said.

What should I do if I don’t have any referees?

Applying for a rental without any referees presents a problem, as the property manager has no way to verify reliability.

Ms Wilde said in some circumstances, tenants can ask for their parents’ names to go on a lease, but this is done on a case-by-case basis.
